By accessing or using the BODMart platform — including our website, mobile application, and related services — you agree to be bound by these Terms and Conditions. Please read them carefully before making any purchase or using our services. If you do not agree with any part of these terms, please do not use our platform.
1. Acceptance of Terms
By using BODMart you confirm that you are at least 16 years old (or have the consent of a parent/guardian), that the information you provide is accurate, and that you will comply with all applicable laws and these Terms. We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance.
2. Account Registration
To place orders you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use. BODMart reserves the right to suspend or terminate accounts that violate these Terms.
3. Product Listings & Pricing
We strive to ensure all product descriptions, images, and prices are accurate. However, errors may occur. BODMart reserves the right to correct pricing errors and cancel orders placed at incorrect prices. All prices are listed in Nigerian Naira (₦) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice.
4. Orders & Payment
Placing an order constitutes an offer to purchase. BODMart reserves the right to accept or decline any order. Payment must be completed in full before an order is processed. We accept Paystack, bank transfer, and other payment methods listed at checkout. A confirmation email or message will be sent upon successful payment.
5. Delivery & Shipping
Delivery timelines are estimates and may vary based on location, availability, and external factors such as public holidays. BODMart is not liable for delays caused by third-party logistics providers or circumstances beyond our control. Risk of loss and title for items pass to you upon delivery. 6. Returns & Refunds
Our return and refund process is governed by our Refund & Return Policy, which is incorporated into these Terms by reference. By purchasing, you agree to the conditions outlined therein.
7. Intellectual Property
All content on the BODMart platform — including text, logos, graphics, product images, and software — is owned by or licensed to BODMart / Black Owned Digital. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent. Unauthorised use may result in legal action.
8. User Conduct
You agree not to: (a) use the platform for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) attempt to gain unauthorised access to any part of the platform; (d) post offensive, defamatory, or harmful content in reviews or messages; (e) use automated bots or scrapers on our platform without permission.
9. Reviews & User Content
By submitting a product review or other user content, you grant BODMart a non-exclusive, royalty-free licence to use, display, and reproduce that content. You confirm the content is your own and does not infringe any third-party rights. We reserve the right to remove any content that violates these Terms or our community guidelines.
10. Limitation of Liability
To the maximum extent permitted by law, BODMart and Black Owned Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) our platform or products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.
11. Privacy
Your use of BODMart is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the platform, you consent to the practices described therein.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Nigerian courts.
